These Terms of Use govern your use of hearthwellchimney.com and the Hearthwell service, operated by Rankwire LLC. By using the site or submitting a request, you agree to these Terms.
1. What Hearthwell does
Hearthwell is a free referral service. We help homeowners find independent chimney contractors who serve their area. Hearthwell is not a contractor, does not perform any work, and is not a party to any agreement between you and a contractor. Contractors are independent businesses, not our employees or agents. Contractors may pay us a fee for referrals.
2. No guarantee or endorsement
We ask contractors in our network to confirm that they hold the licenses and insurance required in their area, and we remove contractors who don’t meet our standards. However, we do not guarantee the quality, timing, pricing, safety, or legality of any contractor’s work. Before hiring, you should verify licenses and insurance, check references, and get a written contract. Any estimate, warranty, or agreement is solely between you and the contractor.
3. Consent to be contacted
When you submit a request, you ask us to share it with a vetted local pro and agree that we and the contractor(s) may contact you about your request at the phone number and email you provide. If you check the text-message consent box, you also agree to receive calls and texts as described next to that box, which may use automated technology or prerecorded messages. Consent is not a condition of any purchase. You can opt out of texts at any time by replying STOP. See our Privacy Policy.
4. Your responsibilities
You agree to provide accurate information, to submit requests only for property you own or are authorized to request work for, to be at least 18 years old, and not to use the site for any unlawful, fraudulent, or abusive purpose (including submitting another person’s information).
5. Cost information
Price ranges and other information on this site are general estimates for educational purposes. Actual prices depend on your home, location, materials, and the contractor, and can differ significantly.
6. Intellectual property
The site content, design, and trademarks belong to Rankwire LLC or its licensors. You may not copy or reuse them without permission.
7. Disclaimers
THE SITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RANKWIRE LLC AND ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY ACT OR OMISSION OF ANY CONTRACTOR. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
9. Indemnity
You agree to indemnify and hold harmless Rankwire LLC from claims arising from your misuse of the site or violation of these Terms.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except where the law of your state of residence requires otherwise.
11. Changes
We may update these Terms by posting a new version here. Continued use of the site means you accept the updated Terms.
